The U.S. Supreme Court has issued a landmark decision affirming that states may protect girls’ and women’s sports by limiting participation based on biological sex. In a pair of cases involving Idaho and West Virginia, the Court upheld state laws designed to preserve fair competition in female athletics, ruling that Title IX’s reference to “sex” means biological sex.
The decision marks a significant victory for women and girls across America. With 27 states already having enacted similar protections, the ruling provides strong constitutional support for laws that seek to ensure female athletes have the opportunity to compete on a level playing field.

While the ruling represents a major milestone, the work is not yet complete. ADF notes that 23 states have not yet passed similar protections for women’s sports, meaning legislative efforts will likely continue across the country.
