In a major victory for free speech and parental rights, the U.S. Supreme Court ruled 8–1 in favor of a Colorado counselor in a case argued by Alliance Defending Freedom (ADF)—a leading legal organization dedicated to protecting religious liberty, the sanctity of life, free speech, and parental rights. The decision reinforces that the government cannot control private conversations between counselors and their clients.
The case focused on Kaley Chiles, a licensed professional counselor in Colorado who works with clients navigating deeply personal challenges, including trauma, addiction, and identity-related issues. Many of her clients seek counseling that aligns with their Christian faith and personal values. However, a 2019 Colorado law restricted what she could say to clients under 18 regarding gender identity, placing her in an impossible position—either withhold guidance her clients were actively seeking or risk fines and the loss of her license.
Under the law, counselors were permitted to encourage gender transition but were prohibited from helping clients who wanted to grow comfortable with their biological sex. This one-sided restriction forced Chiles to censor herself in sessions and, in some cases, turn away clients altogether. After lower courts ruled against her, the case ultimately reached the Supreme Court.
The Supreme Court rejected Colorado’s position, making clear that counseling conversations are protected speech under the First Amendment. The ruling affirms that states cannot silence certain viewpoints or force professionals to promote government-approved perspectives in private, therapeutic settings.
This decision has national implications. With similar laws in more than 20 states, the Court’s ruling sets a precedent that protects counselors, strengthens parental rights, and ensures that individuals can seek guidance that aligns with their values and beliefs.
